GENERAL TERMS AND CONDITIONS OF SALE

1. GENERAL PROVISIONS
These General Terms and Conditions of Sale (the "Terms") set out the terms on which SABRACADABRA LTD ("SABRACADABRA", "we", "us", or "our") sells products to consumers ("you") through our websites, mobile sites and any other online channel that links to these Terms (collectively, the "Website").
SABRACADABRA LTD is a company incorporated in England and Wales. As we expand, these Terms will continue to apply to purchases made via our online channels, unless expressly stated otherwise.
The sale of products through the Website is intended exclusively for consumers acting for personal purposes and not for resale, commercial, professional or trade purposes. By placing an order, you confirm that you are purchasing for personal use only.
By placing an order on the Website, you agree to be bound by these Terms, our Privacy policy and our Cookie Policy. If you do not agree, you must not place an order.
We may update these Terms from time to time. The Terms applicable to your order are those in force at the time you place your order, as displayed on the Website during checkout.
2. PRODUCT INFORMATION AND AVAILABILITY
Information on our products, including descriptions, materials, colours, sizes and prices, is available on the Website. We take reasonable care to ensure that the information is accurate and up to date.
Images of products on the Website are for illustrative purposes only. Although we make every effort to display colours and details accurately, we cannot guarantee that your device's display will reflect the products exactly. You should rely on the written descriptions and characteristics provided on the product page.
All products offered for sale are subject to availability. We do not guarantee that any product will be permanently available. We reserve the right to limit quantities, restrict the number of units per customer and to withdraw any product from sale at any time.
We may refuse any order that appears to us, in our reasonable opinion, to be placed in breach of these Terms, including orders that appear to be placed for resale or any unauthorised commercial purpose.
3. PRICES, TAXES AND DUTIES
Prices for products are displayed on the Website in the currency indicated for your chosen shipping destination. Prices include applicable value added tax (VAT) or sales tax, where required by law, unless otherwise stated.
Delivery charges, if applicable, will be shown separately during the checkout process before you confirm your order.
Depending on your shipping destination, additional customs duties, import taxes or local charges may apply. Where we offer a delivered duty paid (DDP) option, those amounts will be displayed at checkout. Where duties and taxes are not collected at checkout, you are responsible for any such charges levied by local authorities.
We may change our prices at any time; however, such changes will not affect orders for which we have already issued an Order Confirmation.
4. ORDERING PROCESS AND CONTRACT FORMATION
To place an order on the Website, you must:
Select the product or products you wish to purchase and add them to your bag.
Review the contents of your bag, adjust quantities if needed and proceed to checkout.
Provide accurate and complete billing, shipping and contact information.
Choose your preferred shipping method and payment method from those available.
Review and accept these Terms, the Privacy Policy and any other applicable terms, then submit your order.
After you place an order, we will send you an email acknowledging that we have received it. This acknowledgement does not mean that your order has been accepted.
We accept your order, and a contract of sale is formed, only when we send you an email confirming that the products have been dispatched (the "Order Confirmation"). If we are unable to accept your order, we will inform you and will not charge you for the products or will refund any amounts already paid.
5. PAYMENT
You must pay the total price of the products, including applicable taxes, duties (if collected at checkout) and delivery charges, using one of the payment methods offered on the Website at the time of purchase.
Payments are processed securely by our payment service providers, such as Stripe. We do not store your full card details. Your use of third-party payment services is subject to the terms and privacy policies of those providers.
We reserve the right to perform checks to prevent fraud and unauthorised activity. If your payment cannot be authorised or is otherwise refused, your order will not be processed.
For each accepted order, an electronic receipt or invoice will be issued based on the information you provided. You are responsible for ensuring that this information is accurate and complete.
6. DELIVERY
We deliver to the countries or regions indicated at checkout. The available shipping options, estimated delivery times and delivery charges will be shown before you confirm your order.
Delivery times are estimates only and are not guaranteed. We are not responsible for delays outside our reasonable control, including delays caused by customs clearance, carrier operations, strikes, adverse weather or other events of force majeure.
You must provide a complete and accurate delivery address. If a delivery is delayed or cannot be completed because of an incorrect or incomplete address, we will not be responsible for any resulting loss or inconvenience, and additional delivery charges may apply.
7. TRANSFER OF OWNERSHIP AND RISK
Ownership of the products passes to you when we receive full payment of all sums due in respect of the products, including shipping costs and taxes, and when the products are dispatched to you.
Risk of loss or damage to the products passes to you upon delivery to the address you provided or, where applicable, upon collection by you or a carrier acting on your behalf.
8. RETURNS, CANCELLATIONS AND LEGAL WITHDRAWAL RIGHTS
Our returns, exchanges and cancellations rules are described in detail in our RETURN AND EXCHANGE POLICY, which forms part of these Terms.
If you are a consumer in the United Kingdom or the European Union, you may have a statutory right to withdraw from your online purchase within a fixed period (cooling off period), usually 14 days from the day after you receive the products. Our Return and Exchange Policy explains how this right applies and how you can exercise it.
In addition to any statutory rights, we may offer a contractual return period and conditions that are more favourable. Where our policy is more generous than local law, the policy will apply without limiting your statutory rights.
9. DEFECTIVE OR NON-CONFORMING PRODUCTS
We take care to ensure that our products meet our quality standards. If you receive a product that is defective, damaged, or does not match the description on the Website, please contact our customer service as soon as reasonably possible with details and supporting images.

any loss that is not caused by our breach of these Terms or by our negligence;
any business-related losses or damages, including loss of profit, revenue, contracts, data, goodwill or business opportunity; or
any indirect or consequential loss or damage, except where such limitation is not permitted by mandatory consumer laws.
We are not responsible for failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control (force majeure), such as natural disasters, strikes, wars, pandemics, governmental actions or failures of telecommunications networks.
11. PERSONAL DATA AND COOKIES
We collect and use your personal information when you place an order, create an account or interact with us in connection with a purchase. Our processing of your personal information is governed by our Privacy policy.

12. GOVERNING LAW AND JURISDICTION
These Terms and any contract for the sale of products to you are governed by the laws of England and Wales, without prejudice to any mandatory consumer protection rules that apply in the country where you habitually reside.
If you are a consumer resident in the UK or the EU, you may bring any dispute relating to these Terms or your purchase before the courts of your place of residence. Nothing in this clause limits your rights under applicable consumer law.
